APPROVAL OF MOTION 90 DASH 0 6 1 4 BY CITY COUNCIL APPOINTED THE PLANNING COMMISSION AS THE CAPITAL IMPROVEMENTS ADVISORY COMMITTEE.

IN SUMMARY OF THE SEMI-ANNUAL REPORT, I OFFER THE FOLLOWING FINDINGS, A TOTAL OF $27,144,778 AND 97 CENTS WAS GENERATED FROM REVENUE AND INTEREST FOR WATER AND WASTEWATER IMPACT FEES ACCRUED IN THE IMPACT FEES ACCOUNT BETWEEN MAY 1ST, 2025 AND OCTOBER 31ST, 2025, THE FIRST HALF OF THE SIXTH YEAR OF THE 20 20 20 30 IMPACT FEE PROGRAM.

THE CURRENT WATER AND WASTEWATER IMPACT FEE OF $4,286 AND 93 CENTS PER SERVICE UNIT FOR WATER AND WASTEWATER IS 38.6% OF THE MAXIMUM FEES ALLOWED BY CURRENT LAW.

THE WATER AND WASTEWATER IMPACT FEES IN EFFECT FOR THIS REPORTING PERIOD HAVE BEEN EFFECT IN EFFECT SINCE JULY 1ST, 2025.

WITH THE IMPLEMENTATION OF THE 20 20 20 30 IMPACT FEE PROGRAM ADOPTED BY CITY COUNCIL, THE NUMBER OF SERVICE UNITS THAT GENERATE THE 27,144,000 787 770 $8 AND 97 CENTS WAS 5,841 SERVICE UNITS FOR WATER AND 6,723 SERVICE UNITS FOR WASTEWATER.

A TOTAL OF 647 SINGLE FAMILY RESIDENTS WERE EXEMPT FROM PAYING IMPACT FEES AND WERE GRANTED SINGLE FAMILY RESIDENTS BELOW MEDIAN HOUSING PRICE DURING THIS PERIOD.

EXAMINATION OF THE DATA REGARDING SERVICE UNITS CONSUMPTION FROM MAY 1ST, 2025 THROUGH OCTOBER 31ST, 2025 INDICATES SIGNIFICANT CAPACITY REMAINS IN THE WATER AND WASTEWATER SYSTEMS TO SUPPORT THE ANTICIPATED DEMAND THROUGH JULY 1ST, 2026, THE END OF THE NEXT REPORTING PERIOD.

BASED ON THESE FINDINGS, I RECOMMENDED THE PLANNING COMMISSION ACTING AS THE CAPITAL IMPROVEMENTS ADVISORY COMMITTEE AUTHORIZE THE APPROPRIATION TO DEBT RETIREMENT FOR THE TOTAL AMOUNT OF REVENUE AND INTEREST GENERATED FROM WATER AND WASTEWATER IMPACT FEES DURING THE REPORTING PERIOD IN THE SUM OF $27,144,778 AND 97 CENTS.

UH, THE ENTIRE NEIGHBORHOOD IS, UM, USES DITCHES, UM, AS DRAINAGE SYSTEM.

SO OBVIOUSLY I'M CONCERNED, UH, AS THE CURRENT RESIDENTS, AS INCLUDING MYSELF.

THE HOUSES HAVE FLOODED MULTIPLE TIMES PRIOR TO ANYTHING BEING DEVELOPED ON THIS LOT.

NOW, MY MAIN CONCERN IS THAT I HEARD THAT THE DEED RESTRICTIONS HAVE SINCE EXPIRED.

UM, ACCORDING TO THE DOCUMENTS THAT I FOUND ON THE DEED RESTRICTIONS, THEY ARE RENEWED EVERY 10 PLUS YEARS.

UM, THERE IS A CIVIC CLUB THAT IS ACTIVE IN THE NEIGHBORHOOD.

WE HAVE MET ON THIS, UH, DISCUSSION AND I BELIEVE THERE IS A MISUNDERSTANDING AS FAR AS THE DEED RESTRICTIONS NOT BEING VALID.

UH, WE HAVE MULTIPLE DEVELOPERS COMING IN THERE AND DOING THINGS THAT ARE NOT, UM, IN COMPLIANCE WITH THE EXISTING DEED RESTRICTIONS.

SO ACCORDING TO THE DEED RESTRICTIONS THAT HAVE BEEN FILED, UH, ONLY ONE SINGLE FAMILY RESIDENCE AND ONE DETACHED GARAGE CAN BE BUILT ON A LOT.

THERE IS A LOT SIZE RESTRICTION THAT THE PROPERTY COULD NOT BE LESS THAN 50 FEET WIDE ACCORDING TO THE ORIGINAL PLANT.

THAT PLAT THAT IS DIVIDED RIGHT THERE MUST REMAIN THAT SIZE.

AND ACCORDING TO THE DOCUMENTS THAT WERE LISTED, THEY DID SAY THEY WANTED TO PUT TWO RESIDENCES, WHICH IS AGAINST THE DEED RESTRICTIONS AS FILED.
