UH, I JUST WANTED TO LET EVERYONE KNOW THAT, UH, THE 30, THE MAYOR WHITMEYER 30 DAY RESIDENTIAL PERMIT PILOT PROGRAM OFFICIALLY LAUNCH ON JULY THE SEVENTH.

UH, THIS INITIATIVE IS A PART OF A LARGER EFFORT TO EXPEDITE CITY OPERATIONS AND TO REBUILD PUBLIC TRUST IN LOCAL GOVERNMENTS CAPACITY TO FACILITATE RESPONSIBLE DEVELOPMENT.

IN OUR THIRD WEEK OF THE PILOT AT THE PERMIT CENTER OF THE 50 APPLICATIONS PARTICIPATING IN THE PROGRAM, I AM PLEASED TO SAY THAT 31 PROJECTS HAVE BEEN APPROVED BY ALL DEPARTMENTS IN LESS THAN 30 DAYS ALREADY.

IF PROVEN, THE PROGRAM COULD PAVE THE WAY FOR A BROADER REFORMS IN THE COMMERCIAL AND MULTIFAMILY PERMITTING PROCESS.

THE SUBJECT SITE IS A 1.2 ACRE PROPERTY LOCATED IN HARRIS COUNTY ETJ AT THE INTERSECTION OF SPRING S STUEBNER AND FALL ROAD.

THE PURPOSE OF THE REPLAY IS TO TURN FIVE LOTS INTO ONE COMMERCIAL RESERVE.

THERE ARE NO VARIANTS REQUESTED WITH THIS ITEM, AND THE APPLICANT HAS MET ALL NOTIFICATION REQUIREMENTS.

ACCORDING TO DEED RESTRICTIONS, HE LIED TO US.

HE SAYS IT'S GONNA BE A BARNDOMINIUM WITH TWO BEDROOMS, IT'S GONNA HAVE KITCHEN AND A FAMILY WILL LIVE THERE.

THERE IS NO SUCH PLACE.

IT IS A LITTLE OFFICE IN THERE, AND THAT'S ALL THERE IS TO IT.

UH, HE LIED TO THE COUNTY.

UH, HE'S GUILTY OF PERJURY ON A GOVERNMENT DOCUMENT, AND THAT IS HE FILLED OUT RESIDENTIAL REQUESTS FOR PERMITS AND THE WHOLE TIME HE KNEW IT WASN'T GONNA BE THERE.

AND I UNDERSTAND ALSO, DOES THE CITY OF HOUSTON HAVE RESPONSIBILITY ON THIS ALSO? UM, I HAVE JUST RECENTLY LEARNED THAT I THINK YOU DO AND WE WOULD APPRECIATE YOUR HELP ON IT TO GET ALL OF THESE METAL BUILDINGS, ALL OF THESE COMMERCIAL INSTALLATIONS OUT.

I CAN'T BACK OUTTA MY DRIVEWAY A LOT OF TIMES BECAUSE HE'S GOT TRUCKS AND TRAILERS PARKED UP AND DOWN AND ALONG THE STREET.

THE HOMES ARE PROPOSED TO BE BUILT ON A STREET WITH SIGNIFICANT FLOODING.

MANY OF THE HOMES ON THE STREET AND IN THIS NEIGHBORHOOD HAVE CONTINUOUS STRUCTURAL FLOODING.

WHILE WE ARE WORKING ON A FLOOD MITIGATION PROJECT IN THE NEIGHBORHOOD, IT IS VERY DIFFICULT.

IT IS A VERY DIFFICULT ENGINEERING PROJECT AND QUITE COMPLICATE COMPLICATED IT TO MITIGATE FLOODING DUE TO MANY FACTORS INCLUDING AGING INFRASTRUCTURE AND, UH, NO AREAS TO DRAIN THE WATER.

GIVEN THE CIRCUMSTANCES BUILDING 18 HOMES ON THIS STREET, THAT ALMOST CERTAINLY WILL FLOOD IS COMPLETELY IRRESPONSIBLE.

I UNDERSTAND THE CONSTRAINTS THAT THE PLANNING COMMISSION MUST OPERATE IN AND YOU ARE GOVERNED BY STATE LAWS THAT DO NOT ALWAYS ALLOW YOU TO VOTE AGAINST ITEMS SIMILAR TO THIS.

HOWEVER, I ASK THAT YOU TAKE CAREFUL CONSIDERATION ON THIS ITEM IN CASE THERE ARE ANY ACTIONS YOU ARE ALLOWED TO TAKE.

THIS STREET CONNECTION IS IMPORTANT TO MAINTAIN UM, FOR NEEDED EAST WEST CONNECTION WITHIN THIS MAJOR THOROUGHFARE BLOCK AS THERE ARE NONE SOUTH OF THE DRAINAGE CHANNEL THAT BISECTS THIS BLOCK AND THIS AREA IS FAIRLY RAPIDLY DENSIFYING.

ADDITIONALLY, THE SITE WIDTH IS APPROXIMATELY 600 FEET, WHICH ALLOWS FOR BOTH A STREET AND REASONABLE USE OF THE LAND.

HARRIS COUNTY ENGINEERING ALSO OBJECTS TO THE REQUEST.

THE PROPERTY ALONG THE REMAINDER OF HAR HARRINGTON STREET IS CURRENTLY VACANT AND DOUBLE FRONTS ALSO ALONG PICNIC STREET TO THE NORTH FOR VARIANCES TWO, THREE AND FOUR.

A ZERO FOOT BUILDING LINE ALONG HARRINGTON STREET, NO VISIBILITY TRIANGLE AT THE INTERSECTION OF HARRINGTON AND KEEN STREET AND A SEVEN FOOT DUAL BUILDING LINE ALONG A PORTION OF KEEN STREET ALONG HARRINGTON STREET.

THE PROPOSED ADDITION IS PLANNED TO BE AN EXTENSION OF THE EXISTING BUILDING LOCATED AT THE PROPERTY LINE.

THE THREE FEET HIGH PLANTER BOX IS PROPOSED TO EXTEND ONLY ONE FOOT THREE INCHES PAST THE BUILDING FACADE.

THE ROOF PARAPET IS 10 FEET ABOVE GRADE WITHOUT COLUMN SUPPORT AND EXTENDS THREE FEET FROM THE BUILDING TO PROVIDE COVERED WALKWAYS ALONG THE BUILDING.

THESE SAME PROPOSED ENCROACHMENTS ALONG HARRINGTON STREET ARE WITHIN THE RIGHT OF WAY AND ARE SUBJECT TO HOUSTON PUBLIC WORKS'.

SEPARATE REVIEW PROCESS FOR THE LAST VARIANCE REQUEST, THE ORDINANCE REQUIRES THAT A TOD TRANSIT ORIENTED DEVELOPMENT STREET HAS ADDITIONAL PEDESTRIAN REALM REQUIREMENTS DUE TO THE NATURE OF THE STREET SEGMENTS PROXIMITY TO A RAIL STATION.

STRICT INTERPRETATION OF THE ORDINANCE RESTRICTS AUTO RELATED USES WITHIN THE PEDESTRIAN REALM EXCEPT FOR DRIVEWAY ENTRIES AND DROP OFF LANES.

THE APPLICANT IS PROPOSING TO CONSTRUCT A NEW 2,600 SQUARE FOOT SINGLE STORY DUPLEX ON A VACANT LOT AND IS REQUESTING A VARIANCE TO ALLOW A 15 FOOT BUILDING LINE ALONG EAST CROSS TIMBER STREET.

IN LIEU OF THE ORDINANCE REQUIRED 25 FOOT BUILDING LINE ALONG A MAJOR THOROUGHFARE STAFF IS IN SUPPORT OF THE REQUEST.

THE SITE WAS PLOTTED AS A 69 FOOT WIDE LOT WITHIN THE TRIANGLE GARDEN SUBDIVISION WITH A 10 FOOT SIDE BUILDING LINE AND A 25 FOOT FRONT BUILDING LINE RECORDED IN 1944.

AT THAT TIME, CROSS TIMBERS WAS PLOTTED AS ERNIE STREET, A LOCAL STREET WHEN EAST CROSS TIMBERS WAS PIECED TOGETHER AND WIDENED.

10 FEET OF WIDENING WAS TAKEN, LEAVING 59 FEET OF REMAINING LOT WIDTH, APPLYING THE ADDITIONAL 25 FEET BUILDING LINE LEAVES 34 FEET OF BILLABLE AREA.

THE ORDINANCE ALLOWS FOR A REDUCED BUILDING LINE OF 15 FEET ALONG MAJOR THS OF 80 FEET OR LESS, IN WHICH EAST CROSS TIMBERS IS WHEN SUBDIVIDING THE LOT AND USING SHARED VEHICULAR ACCESS.

BECAUSE THIS PROPERTY IS NOT SUBDIVIDING, THE REDUCED BUILDING LINE OF 15 FEET BY RIGHT IS NOT AVAILABLE.

THE INTENT OF THE ORDINANCE HOWEVER, IS BEING MET BECAUSE THE EXISTING LOT IS PROPOSING A SINGULAR DRIVEWAY APPROACH FOR THEIR PROPOSED DUPLEX ALONG THE LOCAL STREET AND IS PROPOSING TO CLOSE IN THE EXISTING CURB CUTS ALONG EAST CROSS TIMBERS.

ADDITIONALLY, ALONG A MAJOR THOROUGHFARE, A SIX FEET WIDE SIDEWALK IS REQUIRED.

STAFF RECOMMENDS TO APPROVE THE REQUESTED VARIANCE TO ALLOW A REDUCED BUILDING LINE OF 15 FEET ALONG A MAJOR THOROUGHFARE.

STAFF HAS NOT RECEIVED ANY PUBLIC COMMENTS IN ADVANCE.
