THE CHANGES TO CHAPTERS 42 AND 26 WE'RE APPROVED BY CITY COUNCIL WITH ONE TABLE AMENDMENT LAST WEEK.

UM, WE ARE VERY PLEASED THE TABLE AMENDMENT MADE THE, MADE THE RECOMMENDATIONS EVEN BETTER.

UH, THE PLANNING AND DEVELOPMENT DEPARTMENT TEAM CELEBRATED THESE THREE YEARS OF RESEARCH DISCUSSIONS, COMMUNITY ENGAGEMENT AND COLLABORATION AFTER CITY COUNCIL APPROVED THEM.

THE ORDINANCE CHANGES WILL BE EFFECTIVE NOVEMBER 27TH.

UM, WE ARE PUBLISHING A USER'S GUIDE THAT YOU ALL WILL SEE PROBABLY WITHIN THE NEXT TWO TO THREE WEEKS.

AND, UM, THERE WILL PROBABLY BE A COUPLE QUESTION AND ANSWER SESSIONS.

THE OFF TO PARKING ORDINANCE, THE AMENDMENT TO SECTION 26 REQUIRE THE COMMISSION TO APPROVE AN ANNUAL CALENDAR THAT DETAILED THE SUBMITTAL PERIOD.

FOR EACH TYPE OF APPLICATION THAT REQUIRE APPROVAL BY THE COMMISSION TO ONE APPROVED, THE DIRECTOR IS REQUIRED TO PUT THE CALENDAR ON THE DEPARTMENT WEBSITE.

SO BEFORE YOU IS THE CONSIDERATION OF THE PROPOSED SUBMITTAL SCHEDULE FOR PARKING VARIANCES AND SPECIAL PARKING AREA APPLICATION THAT RELAY TO ASSISTING PLANNING COMMISSION MEETING DATE FOR THE 2024 CALENDAR YEAR.

WELL NOW THEY HAVE BEEN FOR TWO YEARS BEEN DENIED ACCESS TO A NEW HOME BECAUSE THEY'RE UNDERNEATH THE ONE ACRE MARK.

THE NEIGHBORS NEXT DOOR WHEN THEY BOUGHT THE PROPERTY, HAD BASICALLY TAKEN PART OF THEIR PROPERTY.

THEY PAY CASH FOR IT AND DID NOT KNOW TO DO AN INSPECTION.

AND HENCE WE'RE LOOKING FOR A VARIANCE.

WE OPPOSE THE VARIANCE THAT WOULD ELIMINATE THE 10 FOOT RIGHT OF WAY DECA DEDICATION ON WILLOW BEND BECAUSE THE STREET WILL NEED TO BE WIDENING THE NEAR FUTURE TO ACCOMMODATE INCREASED TRAFFIC FLOW FROM EXISTING AND NEW DEVELOPMENTS.

WESTWOOD IS A COMMUNITY OF APPROXIMATELY 750 RESIDENTS AND A DOZEN OR SO BUSINESSES.

THERE ARE ALSO ANOTHER APPROXIMATELY A DOZEN OR SO BUSINESSES ON THE EAST SIDE OF STELLA LINK.

WILLOW BEND ITSELF HAS SEVERAL BUSINESSES ON THE SOUTH SIDE OF THE STREET, BASICALLY ACROSS FROM THIS PROPOSED SUBDIVISION.

WILLOWBEND BORDERS BOTH ALBION TWO AND WESTWOOD IN THE SOUTH AND INTERSECT STA LINK WESTWOOD'S EASTERN BOUNDARY AND WILLOWBEND IS ALREADY A SIGNIFICANT TRAFFIC ARTERY IN THE NEIGHBORHOOD AT THE CORNER OF STA LINK AND WILLOW BEND.

CITY CHOICE HOMES IS CURRENTLY DEVELOPING 169 UNIT COMMUNITY.

THAT'S A, THERE'S A 20 ACRE VACANT TRACT OF LAND OVER THERE JUST NORTH OF THERE.

THERE IS AN ADDITIONAL 12 ACRE TRACT.

THE CITY OF HOUSTON WAS GOING TO BUILD APPROXIMATELY 240 UNITS ON THAT TRACK, BUT THE PROJECT FELL THROUGH AND THE LAND IS UP

ONCE THE NEW SUBDIVISIONS ARE BUILT, ALL THE NEW BUSINESSES ALONG LINCOLN WESTWOOD RESIDENCES WILL DEPEND ON WILLOW BEND EVEN MORE, UM, AS A THROUGH STREET SINCE STO LINK WILL BE SEVERELY CONGESTED DURING RUSH HOUR, PARTICULARLY IN THE MORNING, BOTH ALBION ONE AND WILLOW BEND POINT.

THE PLANNING COMMISSION SAW A SIMILAR VARIANCE AT THE END OF AUGUST OF THIS YEAR FOR SECTION TWO ABUTTING THE SOUTH OF THIS SITE DUE TO THE CLOSE VICINITY OF TO STATE HIGHWAY 2 88.

THE DEVELOPER COORDINATED WITH TXDOT TO CONSTRUCT A SOUND BARRIER WALL FOR THE FUTURE RESIDENCE BECAUSE TXDOT DENIED THE WALL WITHIN THE RIGHT OF WAY.

THE APPLICANT IS PROPOSING THE WALL THREE FEET WITHIN THE PROPERTY LINE WITHIN A RECORDED 10 FEET SOUND WALL EASEMENT.

THE THREE FOOT BUILDING LINE WOULD PLACE THE PROPOSED SOUND BARRIER WALL BETWEEN 68 FEET AND 95 FEET FROM THE EDGE OF THE HIGHWAY ON RAMP AND MAIN TRAVEL LANDS RESPECTIVELY.

ALL OTHER STRUCTURES MUST ADHERE TO THE ORDINANCE REQUIRED MINIMUM 25 FOOT BUILDING LINE.

HOUSTON PUBLIC WORKS HAS NO OBJECTIONS TO THE REQUEST.

THEREFORE, STAFF RECOMMENDS TO GRANT THE REQUESTED VARIANCE AND APPROVE THE PLAT SUBJECT TO CPC 1 0 1 FORM CONDITIONS.

UM, AND THEN LASTLY, I DO UNDERSTAND STAFF'S CONCERN ABOUT NOTIFICATION, BUT I DO WANT TO ASSURE EVERYONE THAT ON THE COMMISSION THAT OUR CLIENT DOES HAVE A LETTER OF SUPPORT FROM THE HOA.

WE'RE NOT TRYING TO HIDE ANYTHING FROM THE NEIGHBORHOOD.

SO OUR CLIENT FEELS THAT THIS IS THE PREFERRED ACCESS POINT, SINCE IT'S AT A 90 DEGREE ANGLE AND IT, THERE'S ALREADY AN EXISTING, I WOULDN'T CALL IT A CURB CUT THERE, BUT THERE'S AN EXISTING USE THAT HAD BEEN HAPPENING ON THAT UNRESTRICTED RESERVE, UM, THAT WAS USING THAT ACCESS POINT.

AND WE DO WE HAVE THE ACTUAL LETTER FROM THE CIVIC ASSOCIATION APPROVING IT? WAS THAT IN OUR MR PRESENTATION? SEDILLO? OH, THERE IT IS.
