OF THE HOUSING AND COMMUNITY AFFAIRS COMMITTEE, I OFFICIALLY CALLED THIS MEETING TO ORDER AND WELCOME ALL OF MY COUNCIL, UH, COLLEAGUES, THEIR STAFF AND PRESENTERS THAT ARE IN ATTENDANCE THIS MORNING.

THIS COMMUNITY HOUSING AND COMMUNITY AFFAIRS COMMITTEE IS BEING HELD IN A HYBRID MODE DUE TO THE HEALTH AND SAFETY OF THE PUBLIC DURING COVID-19 PANDEMIC.

THIS IME THIS MEETING IS OPEN TO THE PUBLIC, BUT RESTRICTIONS REGARDING MASK, ALLOWABLE ROOM CAPACITY AND SEATING ARRANGEMENTS MAY BE IN PLACE.

THEREFORE, AS THE PRESIDING OFFICER OF THE MEETING, I AM PHYSICALLY IN PRESIDENT CHAMBERS IN ACCORDANCE WITH THE PROVISIONS OF SECTION 5 5 1 1 27 OF THE TEXAS GOVERNMENT CODE APPLICABLE TO A GOVERNMENTAL BODY THAT EXTENDS INTO THREE OR MORE COUNTIES.

SO TODAY WE'LL HEAR A PRESENTATION FROM OUR HOUSING AND COMMUNITY DEVELOPMENT DEPARTMENT.

IT'LL PRESENT ON THE FOLLOWING 9% TAX CREDIT, SE SELECTION OVERVIEW, UH, PROPOSED HOUSTON TAX CREDIT APPLICATIONS FOR 2023.

COUNCIL RECOMMENDATIONS FOR A RESOLUTION OF SUPPORT FOR THE ALLOCATED 9% WITHIN THE CITY OF HOUSTON AND THE ETJ.

ALSO A RECOMMENDATION FOR EXCEPTION OF T-D-H-C-A DEVELOPMENT RULES.

THIS WILL BE PRESENTED BY OUR DIRECTOR AND DEPUTY ASSISTANT DI, UH, DIRECTOR ANNA MARTINEZ.

BEFORE WE GET STARTED ON THE PRESENTATION, JUST, UM, YOU KNOW, WE DO THIS EVERY YEAR, AND I JUST WANNA REMIND COLLEAGUES AND STAFF.

UM, I WANT, UH, WE HAVE 25 MEMBERS, UH, OF THE PUBLIC SIGNED UP FOR COMMENTS TODAY.

UH, THIS IS OUR ANNUAL PRESENTATION TO LET EVERYONE KNOW, UH, UH, OUR PROCESS THAT THE CITY WENT THROUGH IN DETERMINING THE 9% TAX CREDITS.

UH, IT IS OUR RESPONSIBILITY AS THE GOVERNMENTAL ENTITY TO ACCEPT THOSE PROPOSALS.

WE EVALUATE THEM AND MAKE A RECOMMENDATION TO THIS BODY, UH, FOR, UH, LETTERS OF SUPPORT.

PRESENTING TODAY WILL BE ANNA MARTINEZ AND RYAN BIBBS, WHO HAVE GONE THROUGH THE PAINSTAKING TASK OF EVALUATING EACH AND EVERY PROPOSAL THAT CAME THROUGH THE DOOR.

I BELIEVE WE HAD 33 PROPOSALS WALKED IN, AND WE ARE GOING TO PRESENT TO YOU THE, THOSE THAT, UH, UH, MADE IT THROUGH OUR CRITERIA.

AND ARE, UH, WE ARE GOING TO REQUEST THAT THOSE ARE THE ONES THAT ARE ALLOWED TO RECEIVE THOSE, UH, LETTERS OF SUPPORT.

THIS IS FEDERAL FUNDING THAT'S COMING FROM THE IRS.

THEY'RE AN IMPORTANT RESOURCE FOR BUILDING AFFORDABLE HOUSING THROUGHOUT THE STATE AND THE COUNTRY.

UH, IT WAS CREATED THROUGH THE TAX REFORM ACT OF 1986.

AND HERE IN TEXAS IS ADMINISTERED BY THE T-D-H-C-A, THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS.

UH, IT'S PRIVATE EQUITY FOR CONSTRUCTION OF AFFORDABLE HOUSING, UH, 9% TAX CREDITS ALLOCATED THROUGH A COMPETITIVE PROCESS.

UH, CREDITS ARE SOLD ON AN OPEN MARKET, WHICH DETERMINES THE PRICE.

SO WHAT THE NEXT SLIDE WILL SHOW, IT'S, IT'S THE MECHANICS OF THE TAX CREDIT ALLOCATION.

IT'S A VERY BUSY SLIDE, BUT ESSENTIALLY WHAT IT ILLUSTRATES IS, UH, THE PROCESS, RIGHT? UH, STARTING FROM THE IRS AWARDING THE STATES.

THE STATES THEN AWARDING DEVELOPERS THROUGH THIS APPLICATION PROCESS.

AND THEN THE DEVELOPERS CONVERTING THOSE CREDITS INTO EQUITY, UH, BY SELLING TO INVESTORS WHO THEN, UH, USE THEM TO OFFSET TAX LIABILITY.

THE CITY'S ROLE, IF YOU, IF YOU LOOK AT THE RED LINE, UH, THAT, THAT REALLY IS WHERE THE CITY'S BILL FITS IN.

BUT ESSENTIALLY THE, IT ILLUSTRATES IS, UH, THE PROBLEM, RIGHT? THAT FEEDBACK ADDRESS REWARDING MISTAKES, MISTAKES AND AWARDING DEVELOPERS THROUGH THIS APPLICATION PROCESS.

AND THEN DEVELOPERS CONVERTING THOSE CREDITS INTO EQUITY.

UH, I SELLING TO INVESTORS WHO THEN, UH, USE THEM TO OFFSET .

WE'RE, WE'RE CLEARLY HAVING SOME TECHNIC DIFFICULTY.

UH, SO JUST WRAPPING UP ON THE MECHANICS OF THE TRACKS CREDIT ALLOCATION, UH, OUR PORTION IS, IS A SMALL PART OF THAT RED LINE, WHICH IS THE HOUSING PROJECT, UH, PROPOSAL SUBMITTAL OVER TO THE STATE AGENCY, WHICH IN THIS CASE IS THE T-D-H-C-A.

THE FOLLOWING SLIDE, UH, DESCRIBES JUST THE DIFFERENCE BETWEEN THE 9% AND THE 4% TAX CREDITS.

UH, NINE PERCENTS ARE OBVIOUSLY, IT, IT'S A COMPETITIVE PROCESS.

THEY TYPICALLY FUND ABOUT 70% OF THE, OF THE FINANCING FOR THE DEVELOPMENT.

UH, WHEREAS 4%, UH, IT'S MORE LIMITED.

TYPICALLY, 30 TO 50% OF THE FINANCING SOURCE CREDITS ARE PROVIDED AS AN, UH, OF RIGHT.

UH, SO IT'S NOT

AS COMPETITIVE OF A PROCESS.

HOWEVER, WE DO WANNA FLAG DUE TO THE HIGH DEMAND FOR BONDS, THE 2023 ALLOCATIONS OF PRIVATE BONDS, UH, ARE GONNA BE PROVIDED IN A LOTTERY PROCESS TO ISSUERS AND APPLICANTS.

UH, WITH REGARDS TO SCORING, UH, IT'S A HIGHLY COMPETITIVE SCORING SYSTEM.

THE RESOLUTIONS OF SUPPORT ACCOUNT FOR 17 POINTS OF THE DEVELOPER'S APPLICATION OVER TO THE T-D-H-C-A.

UH, FOR APPLICANTS IN THE ETJ, WE DO LIKE TO HIGHLIGHT HALF THEIR POINTS COME FROM THE CITY, AND HALF THE POINTS COME FROM THE COUNTY.

RESOLUTIONS ARE REQUIRED FROM BOTH.

UH, THE T-D-H-C-A, UH, THIS SLIDE REALLY OUTLINES THE, YOU KNOW, THE, THE HIGH POINTS WITH REGARDS TO LOCAL GOVERNMENT SUPPORT.

THERE ARE ALSO SOME OTHER POINTS AWARDED FOR COMMUNITY PARTICIPATION, BUT THE 17 ACCOUNTS FOR A LARGE PORTION AND COULD POTENTIALLY MAKE OR BREAK, UH, THESE, THESE TRANSACTIONS.

THE NEXT SLIDE DESCRIBES THE SCHEDULE, UH, WHICH WAS CONDENSED, YOU KNOW, OF COURSE, UH, THE T-D-H-C-A, THE, THE GOVERNOR APPROVES THE QAP, I BELIEVE DECEMBER 1ST OF LAST YEAR.

SO IT'S A VERY CONDENSED PROCESS FROM THE TIME THE QAP IS APPROVED TO THE MARCH FULL APPLICATION DELIVERY DATE.

SO, UM, YOU KNOW, LIKE KEITH NOTED, UH, THE MULTIFAMILY TEAM WORKS VERY QUICKLY TO REVIEW ALL OF THE APPLICATIONS THAT COME IN HAND.

OUR APPLICATION, UH, PROCESS, OR OUR APPLICATIONS WERE DUE ON JANUARY 6TH.

AND SO THE MULTIFAMILY TEAM WORKED VERY DILIGENTLY, UH, UNDER RYAN TO REVIEW ALL 33 APPLICATIONS THAT WERE RECEIVED.

UH, OF COURSE, WE'RE HERE FEBRUARY 7TH, UH, WITH THIS PRESENTATION TO HOUSING COMMITTEE, WE ARE PROPOSING A FEBRUARY 15TH COUNCIL DATE WITH THE OPPORTUNITY FOR, UM, YOU KNOW, ANY THAT, YOU KNOW, EITHER ADDITIONAL COMMENT THAT'S NEEDED OR ADDITIONAL CLARIFICATION, UH, WE WOULD NEED THESE APPROVED NO LATER THAN FEBRUARY 22ND IN ORDER TO MEET THE DEADLINE, UH, OF THE T-D-H-C-A TO HAVE FULL APPLICATIONS IN BY MARCH 1ST.

UH, WE DID STIPULATE IN OUR APPLICATION THAT WE WOULD NOT BE FUNDING PROJECTS THAT ARE LOCATED IN THE FLOOD ZONE.

UH, THE NEXT SLIDE OUTLINES THE POINT SYSTEM.

UH, ALL APPLICATIONS ARE REQUIRED TO, TO GET A MINIMUM OF 10 POINTS.

UH, THERE'S A TOTAL OF 27 POINTS AVAILABLE.

SO WE PRIORITIZE, UH, PERMANENT SUPPORTIVE HOUSING FOLLOWED BY GENERAL POPULATION, UH, FOLLOWED BY AGE RESTRICTED POPULATION DEVELOPMENTS.

UH, THE FOLLOWING METRICS THAT WE LOOK AT IS THE HCD SCORE, WHICH GOES BACK TO THE, YOU KNOW, MINIMUM 10 OF THE 27 POINTS.

UH, EACH SCORE RECEIVES A HCD SCORE, WHICH HELPS US TO MAKE THOSE DETERMINATIONS ON WHICH DEVELOPMENTS WILL RECEIVE THE, THE RESOLUTION OF SUPPORT.

UH, THE, THE REALLY, THE TIEBREAKER COMES DOWN TO WHEN NEEDED, UH, COMES DOWN TO POVERTY RATE AND THE SITE COMPARED TO OTHER APPLICATIONS IN THE DISTRICT.

UH, THE NEXT SLIDE DESCRIBES OUR APPEAL PROCESS.

UH, WE REALIZE THERE COULD BE, UH, ADMINISTRATIVE, YOU KNOW, ERRORS THAT ARE MADE.

UH, THIS IS A VERY QUICK PROCESS ON OUR SIDE.

SO, UH, IF THERE IS, THE DEVELOPER FEELS THAT THERE'S BEEN AN ISSUE, THERE'S AN APPEAL PROCESS, APPEALS, WERE ACTUALLY DUE LAST FRIDAY.

IT'S ESSENTIALLY IN A FOOD DESERT AND IT'S DIRECTLY ON A SIX LANE ROAD THAT IS ONE OF THE BUSIEST STREETS IN HOUSTON.

THE CONCEPT OF DISTRI, UH, BETTER DISTRIBUTING AFFORDABLE HOUSING AROUND THE CITY IS A WORTHY GOAL.

UM, THEY ARE OVER CAPACITY PER HISD, UH, STATISTICS LOCATION.

UH, THERE'S 38 DIFFERENT, UH, UH, DIFFERENT COMPLEXES, 16 OF WHICH DELIVERED SINCE 2010.

SO I CAN UNDERSTAND THE PRESSURES ON THE SCHOOL DISTRICT AND THAT IS SOMETHING THAT WE WOULD NEED TO THE CITY OF HOUSTON CERTAINLY, UH, WOULD NEED TO WORK ON.

UM, THERE IS TRANSPORTATION FOR SCHOOLS.

FOUR, TWO OUT OF THE THREE.

UM, THERE WAS COMMENTS ON PARKING, CAR PARKING WILL BE PRESENTED AND PROVIDED ON SITE.

UH, THAT SPECIFIC CORNER OF LAS PALMAS AND RICHMOND IS THE SITE OF MANY, MANY ACCIDENTS, VERY DANGEROUS ACCIDENTS.

WESTLAND IS MAYBE ONE OF THE MOST CONGESTED THE TIME IN THE CITY OF HOUSTON.

WE'VE GOT A LOT OF HISTORY AND TRACK RECORD WITH THE COMMUNITY.

WE ENGAGED THEM, UM, EARLY, AND THE GUIDANCE WAS SENIOR HOUSING.

CURRENTLY IT'S ONLY PERMANENT SUPPORTIVE HOUSING AND FAMILY THAT ARE LISTED.

AND SO MY ENCOURAGEMENT WOULD BE TO, UM, PUT PSH IN A SEPARATE CATEGORY AS WE'VE DONE IN THE PAST TO ADD SENIORS AS A, UH, SUPPORTED PROJECT.

WE, UH, THERE WAS AN ARTICLE WRITTEN ON THE 26TH BY THE SOUTH BEND ELLINGTON LEADER ENDORSING US, UH, ALONG WITH THE CHAMBER OF COMMERCE, UH, CO COUNCIL MEMBER EVAN SHABAZZ'S OFFICE AS WELL.

SO IT WASN'T PACKAGED WITH THIS PACKAGE THAT YOU'RE, YOU'RE VOTING ON.

SUBSEQUENTLY, WE, UH, APPEALED AND WE PROVIDED INFORMATION THAT YOU'RE RAISING THE GROUND SO IT MEETS THE CITY REQUIREMENT TO DEAL WITH THAT ISSUE.

UH, THE POINT I'M TRYING TO EMPHASIZE IS THAT BY MARCH 1ST, WE HAVE TO SUBMIT OUR APPLICATIONS.

WE ARE SPENDING HUNDREDS AND THOUSANDS OF DOLLARS TO PREPARE FOR THAT APPLICATION.

THE LONGER IT TAKES TO HEAR FROM YOU, YOUR APPROVAL, HOPEFULLY THAT MEANS THE METER IS RUNNING.

THERE ARE NO PROJECTS THIS YEAR, BUT I JUST WANTED TO SHARE WITH YOU THAT LAST YEAR THE HOUSING DEPARTMENT GAVE A RESOLUTION TO A PROJECT THAT WE FELT WAS VERY BAD AND THAT PROJECT ENDED UP DYING AND, UM, THAT DID NOT HAVE OUR SUPPORT.

AND I JUST WANNA MAKE SURE IF YOU HAVE ANY PROJECTS IN YOUR NEIGHBORHOOD THAT DID NOT GET SUPPORT, UH, FROM THE HOUSING DEPARTMENT, MAKE SURE THAT THE PROJECTS THAT DID GET SUPPORT HAVE THE NEIGHBORHOOD SUPPORT LIKE OUR SUPER NEIGHBORHOOD DID FOR THE OTHER PROJECTS.

BECAUSE MY UNDERSTANDING LAST YEAR WAS IF THE NEIGHBORHOOD DOESN'T SUPPORT IT, THE PROJECT DIES AT THE STATE LEVEL.

AND IF WE CAN GET THAT TO COMMITTEE TO GET THAT TO ALL COUNCIL MEMBERS.

SO YOU CAN HAVE THAT AS CONTEXT, I THINK THAT'LL BE HELPFUL.

UH, AND THEN I WOULD ENCOURAGE IF YOU ARE A DEVELOPER AND HAVE, OR HAVE A PROJECT AND HAVE NOT REACHED OUT TO YOUR COUNCIL MEMBER, UH, IT IS HIGHLY ENCOURAGED TO DO SO.

COMMUNITY ENGAGEMENT AND THAT PIECE IS VERY IMPORTANT TO THIS PROCESS.
