THE APPLICANT WISHES TO DEVELOP A CELLULAR COMMUNICATIONS TOWER ON THE SITE AND REQUIRES TWO WAIVERS. THE FIRST WAIVER REQUEST IS TO ALLOW A TOWER TO BE LOCATED WITHIN A RESIDENTIAL AREA, AND THE SECOND WAIVER IS TO ALLOW A TOWER TO BE LOCATED WITHIN A FALL ZONE OF A RESIDENTIAL STRUCTURE. THE PROPOSED TOWER IS, UH, 165 FEET IN HEIGHT. AND STAFF WOULD LIKE TO CLARIFY ONE OF THE WAIVERS. UH, WILSON, CAN YOU GO TO THE SLIDE WITH THE CALCULATIONS? UH, WE SHOULD HAVE A GREEN, WITH A GREEN. TECHNICALLY, THE WAY THE ORDINANCE READS, UH, WHAT I BELIEVE THE APPLICANT DID WAS COMBINE SOME OF THE PARCELS BY OWNERSHIP, [00:05:02] WHICH SORT OF OBSCURED THE CALCULATIONS. SO IF YOU STRICTLY LOOK AT THIS FROM NOT, NOT DETERMINING HOW MANY PARCELS A INDIVIDUAL OWNER HAS, BUT HOW MANY PARCELS ARE WITHIN THE TEST AREA BY ITSELF. SO WHAT I BELIEVE THE APPLICANT MAY HAVE DONE IS COMBINE SOME OF THE PARCELS THAT ARE IN COMMON, UH, COMMON OWNERSHIP. SO THERE'S QUITE A FEW PEOPLE THAT OWN MORE THAN ONE PARCEL, BUT THE ORDINANCE DOESN'T DETERMINE PERCENTAGE BASED ON OWNERSHIP OF MULTIPLE PARCELS. IT'S SORT OF TRACKED BY TRACK. SO IF YOU BREAK IT DOWN TRACK BY TRACK, THIS IS ACTUALLY, UH, 58 RESIDENTIAL LOTS AND 84 NON-RESIDENTIAL LOTS, WHICH MOVES THE RESIDENTIAL PERCENTAGE TO 40%, WHICH DOES NOT REQUIRE A WAIVER. SO THE EASIER, EASIER WAY TO EXPLAIN IT IS, UH, SOME OF THE, SOME OF THE LOTS WERE LUMPED TOGETHER DURING THE ORIGINAL AS IT WAS SUBMITTED. SOME OF THE, THE LOTS WERE LUMPED TOGETHER AS FAR AS THE CALCULATIONS, BUT YOU'RE TECHNICALLY SUPPOSED TO SEPARATE THE OWNERSHIP OF THE LOTS FROM, YOU KNOW, JUST 'CAUSE ONE PERSON OWNS THREE LOTS DOESN'T MEAN THAT PERSON ONLY GETS ONE, YOU KNOW, ONE COUNT FOR THE TRACK. IT'S PER EACH LOT THAT THEY OWN AND NOT JUST THE OWNERSHIP. SO, UH, STAFF JUST WANTED TO CLARIFY AND, AND AGAIN, TO BE CONSISTENT, WE LEFT THE, THE WAIVER AS SUBMITTED AND WE FELT IT WAS BEST TO CLARIFY AT THIS MEETING. PER MY, UH, MY, OUR EARLIER DISCUSSION FOR CONSISTENCY, WE LEFT THE WAIVER, BUT TECHNICALLY THERE'S A ONLY A 40%, UH, RESIDENTIAL, UM, 40% RESIDENTIAL AREA WITHIN THE TEST ZONE. SO THAT DOES NOT REQUIRE A WAIVER FOR THE TEST AREA. UM, THE TOWER IS NOT WITHIN A SCENIC AREA OR IN A PARK OR A TRACK OF LAND SURROUNDED BY A PARK. AND STAFF HAS CONFIRMED THIS IS NOT WITHIN A PARK OR A SCENIC AREA. UH, THERE'S ALSO THE SECOND WAIVER, UH, THE NEAREST RESIDENTIAL TRACK IS 206 FEET AWAY, AND THE NEAREST RESIDENTIAL STRUCTURE IS APPROXIMATELY 197 FEET FROM THE PROPOSED TOWER. UH, WHICH IS YOUR SECOND, UH, OR YOUR, YOUR SECOND WAIVER REQUEST. UH, THE LAST OF STAFF'S FINDINGS IS REGARDING TO THE, THE TOWER STRUCTURE WITHIN 1000 FEET. UH, STAFF HAS CONFIRMED THAT THERE IS NOT AN APPROVED TOWER STRUCTURE WITHIN 1000 FEET OF THE EXISTING OF THE PROPOSED TOWER SITE. UH, THERE HAD BEEN OIL TANKS AND STORAGE FACILITIES DOWN IN LOT THREE SINCE THE FORTIES. YOU CAN SEE SOME OF THE OLD PHOTOGRAPHS, AERIAL PHOTOGRAPHS FROM THERE. AND THEN ON LOT THREE, JUST OUTSIDE OF THIS PHOTO TO THE NORTH, ABOUT ANOTHER FOUR BLOCKS, THERE'S AN OLD WATER TOWER THAT HAD BEEN THERE FOREVER. AND THAT'S WHERE T-MOBILE CURRENTLY HAS THEIR ANTENNAS IS ON THAT WATER TANK. THAT WATER TANK HAS BECOME UNSAFE AND THE PLANS ARE TO DEMO THAT OUT AND PULL THAT OUT. AND THE DEVELOPER'S STILL TRYING TO DECIDE HE'S READY. HE'S PROBABLY GOT ALL OF HIS, UM, HIS CONCEPTUAL IDEAS, HOW HE'S GONNA DEVELOP THE LAND DONE NOW. AND THEY'VE, I'VE STARTED SOME CONSTRUCTION WORK, BUT THERE'S DOING A LOT OF DEMOLITION WORK OUT THERE. ACCORDINGLY, WE GOTTA FIND A PLACE TO GET THIS TOWER BACK UP. SO THIS RED AREA IS JUST OFF OF THE OWNER THAT HAD THE WATER TANK. IT'S AN INDUSTRIAL, UH, SHOP. AND THEN JUST TO THE SIDE, IF WE GO TO THE NEXT, YOU GO TO YOUR SLIDE THAT SHOWS THE, THE HOUSE CONCERNING OUR WAIVER. NEXT ONE. THERE YOU GO. SO NOW YOU SEE HERE IN THAT YELLOW BOX THAT IS A RESIDENCE AND I HAVE A PHOTO, I HAVE SOME PHOTOS OF THE STREETS AND EVERYTHING. I COULD SHOW YOU IF YOU WANT. BUT THAT IS A RESIDENCE THERE. ONE REASON WE'VE SITUATED THE TOWER WHERE WE HAVE IN THE SOUTHEAST CORNER IS SO THAT WE HAVE THIS LARGE IN BETWEEN HERE IS A LARGE, THAT ONE WITH 197 ALL OUT IS, THAT'S A LARGE BUILDING THAT IS A LARGE SHOP, ABOUT 20 FOOT HIGH. IT FILLS UP ALMOST OVER HALF OF THAT LOT. AND IT STANDS AS A GUARD BETWEEN OUR TOWER SITE IN THAT HOME. SO WE NEVER USE THE TERM FALL ZONE AND OUR BUSINESS . BUT IF THAT TOWER WERE TO HAVE SOME SORT OF AN ISSUE AND WERE TO COME DOWN, THAT HOUSE IS COMPLETELY COVERED. THE TOWER 165 FEET, IT WOULD COME DOWN ON OUR LANDOWNER'S BUILDING IT. IT'S, SO WE, WE'VE TRIED TO LOCATE WHERE WE HAVE A SAFE BARRIER THERE AWAY. THE OTHER OTHER OPTIONS WE HAD WERE ACTUALLY PUT US CLOSER IN TO RESIDENTIAL AREA. 'CAUSE IF YOU GO BACK TO THE SIGN, THE, UH, MAP WITH THE GREEN AND THE COLORS, YOU'LL NOTICE THE RESIDENTIAL AREAS ARE SPREAD ALL THROUGHOUT THAT, THAT LOCATION. SO WE FELT THIS WAS A PRETTY GOOD COMPROMISE, UH, TO KEEP US AS FAR FROM RESIDENTIAL AS WE CAN WITHOUT LOSING THE COVERAGE THAT WOULD HAPPEN IF WE HAVE TO. UH, WHEN THE WATER TANK COMES DOWN, THE WATER TANK FOR WHAT IT'S WORTH, IS ACTUALLY COVERING A LOT OF THAT RESIDENTIAL AREA, BOTH TO THE, TO THE SOUTH AND TO THE WEST AS WELL AS, YOU CAN'T SEE ON THE MAP, BUT TO THE NORTHEAST OR SOME LARGE SUBDIVISIONS THAT THE TOWER IS COVERING. BY COINCIDENCE, IT'S GONNA BE WONDERFUL WHEN THE DEVELOPMENT IS ALL DONE IN THE INDUSTRIAL AREA. WE'LL HAVE GOOD COVERAGE THERE TOO. WE, WE WON'T HAVE LOST ANYTHING THERE. UM, AND I CAN SAY THAT THE, ON LOT THREE, THERE'S QUITE A BIT OF DEVELOPMENT THAT'S ALREADY GONE IN THERE. QUITE A BIT OF A WAREHOUSING THAT'S ALREADY UP AND RUNNING. SO THAT'S THE, THAT'S THE GIST OF THIS, IS THAT WE WERE TRYING TO REPLACE AN EXISTING TOWER OR WATER TANK. IT DOESN'T SHOW UP ON THE THOUSAND, WITHIN THE THOUSAND FOOT OF US BECAUSE IT'S NOT A, UH, A A A COMMUNICATION TOWER. IT WAS AN OLD WATER TANK. YOU'LL SEE THE ROAD ON KERR IS ALL TORN UP JUST PAST OUR LANDOWNER'S PROPERTY AGAIN, BECAUSE THEY'RE, THEY'RE DEVELOPING THAT, THAT, UH, THAT NORTHERN LOT. HOPEFULLY WE'LL EXTEND ALL THE WAY EASTWARD NOW INTO THAT, INTO THE NEW DEVELOPMENT.
